By the Court:- So That is the mistress of the house in Temple Street. I did not see here there at all. She was coming downstairs as we came from the kitchen. When the Sergeant went outside she was in the sitting room in the ground floor. She remained there with me. She stopped there till the crowd dispersed and then went upstairs. I know the Sergeant. I had seen him before that day. I live in Shaukiwen. I saw the Sergeant/previously in Hongkong, not in Shaukiwan.
I live with my mother and am unmarried.
Mr Slade then again addressed the jury.
The Attorney-Generai did not whly.
I sum up.
Jury find a verdiet unanimously of "not guilty".
Prisoner discharged.
Note. No evidence of the old man was given as he was too ill to make a statement at the Hospital, being unable to speak when the Magistrate went to take his statement on 7th, and no evidence equld be given by the prosecution as to the exact complaint the old man made at the Police Station or whether he named anybody or stated the Sergeant had kicked him, and the defense did not ask this in the crossexamination.
It appeared also that the accused was not arrested or charged till after the death of the old man. The defence rather suggested the ex-policeman Lai Shu had got up the charge against the Acting Sergeant.
